Pre-Nuptial Agreements

Pre-nuptial agreements are entered into by couples who seek to regulate their affairs prior to marriage to deal with their affairs in the event of a breakdown of the marriage. At Clear Solicitors we draft and advise on pre-nuptial agreements for people from a variety of financial backgrounds.

Pre-nuptial Agreements are not legally binding under Irish law. However, they may be considered by the Judge in a Family Law Court determining the division of assets between a separating/divorcing couple.

To ensure a Pre-Nuptial agreement will be considered favourably by a judge if ever required, it is very important that each side have time to consider the terms of the proposals prior to signing (three months is the rule of thumb), have independent legal advice, have fully disclosed their financial information and have entered into an agreement that is fair to both parties.
